1. Acceptance of Terms

By accessing or using the Answero AI platform at https://answeroai.com (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

Answero AI provides an AI-powered phone receptionist that answers calls, handles inquiries, and books appointments on your behalf. The Service operates on a wallet-based, per-minute usage model:

• A minimum initial wallet load funds your account to begin using the Service.
• You are billed per minute of AI assistant usage at rates determined by your plan and any partner-specific markup.
• Your wallet can be topped up manually at any time or automatically when the balance falls below a threshold you configure.
• For customers acquired through a partner, the partner may apply their own per-minute markup on top of the platform rate, and a one-time activation fee may apply.

3. Accounts and Registration

You must provide accurate and complete information during registration. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your credentials.

4. Pricing and Billing

• The Service charges per-minute usage fees based on your selected plan. Rates are displayed before each payment.
• An initial wallet load is required to activate service. The minimum load amount is displayed at checkout.
• Additional wallet top-ups can be purchased manually or configured to occur automatically when your balance falls below a threshold you set.
• For partner-acquired customers, the partner may apply a per-minute markup. A one-time activation fee may also apply as displayed during checkout.
• All prices are in US dollars unless otherwise noted. Payment is processed by our third-party payment gateway; we do not store your payment card details.
• Refund requests for wallet loads must be made within 30 days of the original transaction. Refunds are processed through the original payment method.

5. Acceptable Use

• You may not use the Service for any illegal purpose or in violation of any applicable law.
• You may not use the Service to send unsolicited communications, make threatening calls, or engage in harassment.
• You may not attempt to circumvent usage limits, manipulate billing, or access other users' data.
• You may not reverse-engineer, decompile, or attempt to extract the source code of the Service.
• We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

The Service, including its software, design, and documentation, is the intellectual property of Answero AI, Inc.. You retain ownership of your business data, call recordings, transcripts, and any content you provide. You grant us a limited license to process this data as necessary to provide the Service.

7. Limitation of Liability

To the maximum extent permitted by law, Answero AI, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

8. Warranty Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Termination

You may cancel your account at any time through your dashboard settings. Upon cancellation, your data will be retained for up to 30 days and then deleted, except for transaction records which are retained for 7 years as required by law. We may suspend or terminate your account if you violate these terms, with or without notice.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by email and by posting a notice on the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and each party consents to the personal jurisdiction of such courts.
